Cookie Banner and GDPR

On May 25, 2018, a new EU regulation called GDPR (General Data Protection Regulation) came into effect. According to the GDPR rules, websites are obligated to obtain user consent for processing data using cookies or similar technologies. As the owner of the website, you must meet the requirements of the regulation regarding personal data protection. In a situation where a user appears on the website for the first time, a popup message must be displayed to them. In this message, they will be able to give their consent for storing cookie files. Only when they grant this consent can we activate all analytical and advertising tools.

What are cookies?

So-called cookies are computer data, particularly text files, that are stored on the end user's device while using a website. Cookies are most commonly used to optimize the website usage process and gather data that enables understanding of users' interactions with websites.

  • Every website uses cookies.
  • Cookies are saved by analytical tools.
  • They are used for personalized advertising.

Decisions of authorities.

The President of the Personal Data Protection Office (based on the CJEU judgment) ruled that internet users must give consent to cookies in an active manner. It cannot be passive consent given solely through browser settings. Additionally, it was indicated that clear and comprehensive information should allow the user to easily determine the consequences of their consent.

  • Providing information about cookies alone is insufficient.
  • The user themselves must give consent.
  • The first fines in the European Union.

95% of faulty implementations.

Legal regulations were introduced several years ago, however, unfortunately, a large portion of websites still conduct these actions in an incorrect manner. In many cases, authorities issue warnings and recommendations, but for not meeting the requirements, high monetary penalties can also be imposed.

  • Lack of implementation of any tool.
  • Triggering analytical scripts before obtaining consent.
  • Lack of cookie choices/options.

Implementation of the tool.

What should a correct tool implementation look like?

After entering the website, the user should see a pop-up message where they can either give or not give consent for cookies. In the case of granting consent, cookies activate analytical tools (e.g., Google Analytics 4, Facebook) implemented on the website, which rely on cookies. However, in the case of not granting consent, or until it is obtained, it should be assumed that there is no consent and tracking cookies should not be placed.

Pillars of Tool Operation

The Role and Functions of a Cookie Banner

Communication

The Cookie Banner functions as a mechanism to inform website users about how the website uses cookies. The Cookie Banner is used to notify users about this process and obtain their consent for the use of cookies.

Icon

Transparency

For website users, the cookie banner is one of the most important mechanisms for increasing transparency regarding data processing. Thanks to it, users can understand what data is being collected, how it is being used, and have the option to give their consent or refuse it.

Icon

LAW

Many countries outside the European Union have also implemented regulations regarding online data protection and privacy that impact the use of cookie banners. For example, in California, USA, the California Consumer Privacy Act (CCPA) is in effect, which also requires informing users about collected data and allowing them to opt-out of the sale of their data.
